These Terms govern use of Tower OPS (“Service”) provided to business customers (“Customer”) and their authorized users (“Users”).
Accounts are provisioned by the Customer. Users must keep credentials confidential and use the Service only for lawful business purposes related to telecom / construction field operations.
The Service is provided on a commercially reasonable efforts basis unless a separate SLA is signed. Planned maintenance and force majeure may cause interruptions.
No reverse engineering, abuse of APIs, uploading malware, or attempting to access other customers’ data. We may suspend access for violations.
We own the Service software. The Customer owns their operational data uploaded to the Service. We receive a license to host and process that data to provide the Service.
Fees are defined in the order form or subscription agreement between us and the Customer. Failure to pay may result in suspension.
To the maximum extent permitted by law, our liability is limited to fees paid by the Customer in the twelve (12) months preceding the claim. We are not liable for indirect or consequential damages.
Either party may terminate per contract. Upon termination, the Customer may request a data export within thirty (30) days.
Unless otherwise agreed in writing, these Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
Where the Service processes personal data of crew members and field staff on your behalf, the Data Processing Agreement (DPA) applies in addition to these Terms.
